Article 2: Scope and acceptance of the general conditions of use of Digital Media Services
The use of the Digital Media implies the full acceptance of the terms of service hereinafter described (hereinafter referred to as the “TOF”) which define the rules of use of the Digital Media. The simple use of the Digital Media assumes the full acceptance of theTOF.
The TOF may be modified or supplemented at any time, so users of the Digital Media are invited to consult them on a regular basis.
Lunii makes its best efforts to make the Digital Media available 24 hours a day, 7 days a week. However, an interrupt due to technical maintenance may be decided by Lunii, who will endeavor to communicate the dates and times of the intervention.
Access to Digital Media and its services is provided on an “as is” basis and accessible according to availability.
Digital Media is updated regularly. In the same way, legal notices can be modified at any time: they nevertheless impose themselves on the user who is invited to refer to them as often as possible in order to take cognizance of them.

A “Shop” section is dedicated to the presentation and purchase of “My Story Factory”.
A “LuniiStore” section is dedicated to the presentation and download of the desktop application.
A “Stories” section is dedicated to the presentation of the stories.
A “Team” section aims to introduce the founders of Lunii as well as job offers.
Finally, the section “Help me” is dedicated to the installation and troubleshooting in case of malfunction of “My Factory to Stories”.

A “Home / Shop” section is dedicated to the presentation of contents that can be purchased on the application.
Each content has its own “Product Sheet” page.
A “Library” section lists all the contents that have been purchased.
A “My Account” section allows you to manage account settings.
Lunii strives to provide information on the Digital Media as accurate as possible. However, it can not be held responsible for omissions, inaccuracies and deficiencies in the updating, whether by its own act or by third party partners who provide this information.

Article 5: Intellectual Property and Counterfeiting
Lunii owns the intellectual property rights or holds the rights to use all the elements accessible on the Digital Media, including corporate names, brands, texts, images, graphics, logo, icons, sounds, software.
The content of Digital Media is protected by intellectual property laws. As such, the contents of the Digital Media may not be represented, reproduced, distributed or modified in whole or in part without the express permission of the user.
Any reproduction, representation, modification, publication, adaptation, whatever the means or the process used, of all or part of one of the aforementioned signs is strictly prohibited and incurs the criminal and civil responsibility of the user.
Article 6: Limitation of Liability
Lunii can not be held liable for any direct or indirect damage caused to the user’s hardware when accessing the Digital Media and resulting either from the use of equipment that does not meet the specifications specified in Article 4 , or the occurrence of a bug or incompatibility.
Lunii shall not be liable for consequential damages resulting from the use of the Digital Media.
Interactive spaces (possibility to ask questions in the space “contact”) are available to the users. Lunii reserves the right to remove, without prior notice, any content deposited in this space that contravenes the legislation applicable in France, in particular the provisions relating to data protection. Lunii also reserves the right to challenge the civil and / or criminal liability of the user, in particular in the case of a racist, offensive, defamatory or pornographic message, whatever the medium used (text , photography…).
Article 7: Management of personal data

The purpose of this information is to better understand the user in order to improve the quality of the service offered to him.
In any case Lunii collects personal information relating to the user only the need for invoice edition, order delivery, newsletter registration and after-sales service processing offered by the Media digital. The user provides this information with full knowledge of the facts, in particular when he makes the data himself. It is then specified to the user of the Digital Media the obligation or not to provide this information. In any case, Lunii undertakes to respect the confidentiality of the personal data communicated by each user on the Digital Media and to treat it according to the applicable law.

Article 8: Hypertext links and cookies
The Digital Media contains a number of hypertext links to other sites and / or mobile applications, set up with the permission of Lunii. However, Lunii does not have the possibility to verify the contents of the sites and / or mobile applications thus visited, and will consequently assume no responsibility for this fact.

Users who do not wish contractual relations to be governed by the new version of the UGCs, must notify it and, as of the date from which the new version will take effect, they will have to stop using the services of the Digital Media .
Any changes will take effect immediately and will only apply to users who have access to Digital Services after the change.
Article 10: Applicable Law and Assignment of Jurisdiction
Any litigation relating to the use of Digital Media will be subject to French law. Exclusive jurisdiction shall be conferred on the competent courts of Paris.
